These Terms of Service (“Terms”) are a legal agreement between you and Arthea, LLC (“Arthea”, “we”, “us”) governing your use of the Orion Backgammon app (“Orion”, “the app”). By downloading or playing Orion you agree to these Terms. If you do not agree, please do not use the app.
Orion also handles your data as described in our Privacy Policy, which forms part of these Terms.
Who can play
Orion includes in-app purchases and matches played for virtual coins, so it is intended for teenage and adult players and carries an App Store age rating to match; please follow that rating. You must also be old enough to form a binding contract in your country to make any purchase; if you are a minor, a parent or guardian must agree to these Terms and supervise any purchase. Orion is a game of skill and chance for entertainment only. Coins and other virtual items are wagered and won only in virtual coins: there is no real-money wagering, no cash-out and no real-money prizes, and virtual items have no monetary value.
Your licence to use Orion
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Orion for your own non-commercial entertainment, subject to these Terms. We keep all rights not expressly granted. This app is licensed, not sold, to you.
Your guest profile
Orion needs no sign-up. When you first play online, the app creates an anonymous guest profile identified by a random player ID. You are responsible for activity that happens through your profile on your device. Because there is no password, keep your device secure: anyone using it can play as you.
Fair play & acceptable use
Orion is a competitive game with a public leaderboard. You agree not to:
- cheat, use bots, automation, modified clients, memory editors or any tool that gives an unfair advantage or tampers with the dice, rules engine or ratings;
- exploit bugs, manipulate matchmaking, collude to inflate ratings, or interfere with other players’ games;
- choose a display name that is offensive, impersonates someone, or infringes anyone’s rights;
- attempt to access, probe, disrupt or reverse-engineer our servers or the app except where that restriction is prohibited by law.
Orion’s dice are provably fair: the server commits to a hashed seed before each match and reveals it afterwards so any roll can be verified. We may suspend or remove profiles, reset ratings, or refuse service to protect the integrity of the game.
In-app purchases
Orion is free to play. It offers optional in-app purchases of virtual items (such as coins and gems) processed entirely by Apple through your App Store account. All purchases are subject to Apple’s Media Services Terms, and payment is taken by Apple, not by us. Prices are shown in the app before you confirm and may vary by region and over time.
Virtual items have no real value
- Coins, gems, cosmetics and other in-game items are a limited licence to use digital content within Orion. They are not your property, have no monetary value, and cannot be exchanged for cash, transferred, or redeemed outside the app.
- Once delivered, virtual items are consumed digital content. Except where the law or Apple’s refund process provides otherwise, purchases are final and non-refundable. Refund requests are handled by Apple.
- We may change, rebalance, expire or discontinue virtual items or their prices to keep the game fair and healthy. If we permanently shut down Orion, unused virtual items may be lost without compensation, except where the law requires otherwise.
Our content
Orion, its name, logo, artwork, worlds, characters, sounds, code and the rules engine are owned by Arthea or its licensors and protected by intellectual-property laws. You may not copy, distribute, modify, or create derivative works from them except as allowed by these Terms or the law. The one piece of content you provide, your display name, you grant us a licence to show publicly on the leaderboard.
Service & changes
We work to keep Orion available and fair, but we provide it “as is”and cannot guarantee it will always be uninterrupted or error-free. We may update, add, or remove features, worlds and modes as the game evolves. We may also update these Terms; if we make material changes we will update the “last updated” date and, where appropriate, notify you in the app. Continuing to play after a change means you accept the revised Terms.
Disclaimers & limitation of liability
To the fullest extent permitted by law, Orion is provided without warranties of any kind, and Arthea is not liable for indirect, incidental or consequential losses, or for lost virtual items or progress. Nothing in these Terms limits any rights you have under mandatory consumer-protection law, or our liability for death, personal injury, or fraud where such liability cannot be excluded. Where liability cannot be excluded but can be limited, it is limited to the amount you paid us (if any) in the twelve months before the claim.
Ending the agreement
You may stop using Orion at any time and request deletion of your guest profile (see the Privacy Policy). We may suspend or end your access if you breach these Terms or to protect the game or other players.
Apple App Store
These Terms are between you and Arthea, not Apple. Apple is not responsible for Orion or its content. To the extent required, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If Orion fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Any other claims relating to the app are our responsibility, not Apple’s, as set out above. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. prohibited-parties list.
Governing law
These Terms are governed by the laws of France, without affecting the mandatory consumer-protection rights of your country of residence. Disputes are subject to the competent courts of France, again without removing any right you have to bring proceedings in your home jurisdiction where the law guarantees it.
